1. Agreement to Terms

By accessing or placing an order through monstersofthenorth.ca (the "Site"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use this Site or place an order. These terms apply to all visitors, customers, and users of the Site.


2. About Us

Monsters of the North Powersports Ltd. ("MOTN", "we", "us", or "our") is a powersports performance company based in Saskatoon, Saskatchewan, Canada. We sell performance parts, custom fabricated products, ECU tunes, and accessories for off-road machines. All transactions are conducted in United States Dollars (USD) unless otherwise stated at checkout.


3. Products and Orders

By placing an order, you confirm that you are of legal age in your province or state and have the legal authority to enter into a purchase agreement. We reserve the right to refuse or cancel any order at our discretion.

Product availability is subject to change without notice. In the event a product becomes unavailable after your order is placed, we will contact you to arrange a refund or alternative.


4. Custom and Made-to-Order Products

Certain products sold on this Site are custom made or made-to-order. These include, but are not limited to, custom grill inserts, rad cover panels, rear racks, rad relocate kits, and other fabricated or personalized items.

The following terms apply to all custom and made-to-order products:

  • All custom and made-to-order sales are final. No returns or refunds are accepted once production has begun.
  • Manufacturing lead times are typically 2 to 3 weeks from the date of order confirmation. Lead times may vary and are estimates only.
  • It is the customer's responsibility to provide accurate specifications, including model year, trim, design details, and any other required information at the time of ordering. MOTN is not responsible for errors resulting from incorrect information provided by the customer.
  • Any changes to a custom order must be requested within 24 hours of purchase. Changes cannot be accommodated after production has begun.


5. Returns and Refunds

Returns on standard (non-custom) products are handled on a case-by-case basis at the sole discretion of Monsters of the North Powersports Ltd. To request a return, contact us at monstersofthenorth306@gmail.com before sending any product back.

To be eligible for consideration, returned items must be:

  • Unused and in original, uninstalled condition
  • In original packaging where applicable
  • Accompanied by proof of purchase

We do not accept returns on the following:

  • Custom, made-to-order, or personalized products
  • ECU tunes and digital products once delivered or flashed
  • Electrical components that have been installed or powered
  • Any product that has been modified, installed, or used

Approved refunds will be issued to the original payment method. Shipping costs are non-refundable. Return shipping is the responsibility of the customer unless the return is the result of our error.


6. Shipping

We ship to Canada and the United States. Shipping timelines are estimates and are not guaranteed. MOTN is not responsible for delays caused by carriers, customs, weather, or other circumstances outside our control.

Risk of loss and title for products purchased pass to you upon delivery to the carrier. It is the customer's responsibility to inspect all shipments upon receipt and report any damage or discrepancies within 48 hours of delivery.

Customers are responsible for any applicable customs duties, taxes, or import fees on cross-border shipments.


7. Pricing and Payment

All prices are listed in Canadian dollars (CAD) unless otherwise indicated. USD pricing may be available at checkout based on current exchange rates. Prices are subject to change without notice. We reserve the right to correct pricing errors.

Full payment is required at the time of purchase. We accept payment methods as displayed at checkout. MOTN reserves the right to cancel orders where payment cannot be verified.


8. Performance Parts and Off-Road Use Disclaimer

IMPORTANT: Many products sold by Monsters of the North Powersports Ltd. are intended for off-road and closed-course race use only. They are not designed, tested, or approved for use on public roads or highways.

By purchasing any performance part, ECU tune, clutch component, or related product from this Site, the buyer acknowledges and agrees that:

  • All use of the product is at the buyer's sole risk.
  • Monsters of the North Powersports Ltd. assumes no responsibility or liability for any damage to property, injury to persons, or any other loss or harm arising from the installation, use, or misuse of any product from the date of purchase forward.
  • The buyer assumes full and sole liability for any and all consequences resulting from the use of the product.
  • Monsters of the North Powersports Ltd. makes no warranties, express or implied, regarding the suitability of any product for any specific application beyond its intended off-road race use.
  • Installation of performance parts may void the manufacturer warranty on your machine. It is the customer's responsibility to understand the implications before purchasing.
  • Custom tuning is recommended following the installation of certain performance components. MOTN is not responsible for damage caused by the failure to tune after installation.


9. Limitation of Liability

To the maximum extent permitted by applicable law, Monsters of the North Powersports Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of this Site or any product purchased through it.

Our total liability to you for any claim arising out of or relating to a purchase shall not exceed the amount you paid for the product giving rise to the claim.


10. Intellectual Property

All content on this Site, including logos, product images, descriptions, branding, and design elements, is the property of Monsters of the North Powersports Ltd. or its suppliers and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content from this Site without prior written permission.


11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Saskatchewan.


12. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting to the Site. Your continued use of the Site following any changes constitutes your acceptance of the revised terms. We recommend reviewing this page periodically.
